First same-sex marriage license issued and ceremony performed in Travis County

Fox 7 has learned that the first same-sex marriage license has been issued and ceremony conducted in Travis County. Sarah Goodfriend and Suzanne Bryant were married today in Austin, Texas.

However, the Travis County Clerk's Office says this ruling only applies to the medically fragile couple. Additional licenses issued must be court ordered. According to the Petition and Orders released by the Travis County Clerk's Office, "...Goodfriend has been diagnosed with and received extensive treatment for ovarian cancer, a life-threatening illness, with all of the inevitable, attendant stress and disruption of life and family; thus, her future remains very uncertain."

The Travis County Clerk's Office issued the following statement...

Travis County Clerk Dana Debeauvoir, was served with a State Court order from the 167th Judicial District Court (see attached), Travis County, Texas, signed by the Honorable Judge David Wahlberg this morning.

The TRO commands Ms. Debeauvoir to immediately "cease and desist relying on the unconstitutional Texas prohibitions against same-sex marriage as a basis for not issuing a marriage license specifically to Plaintiffs Sarah Goodfriend and Suzanne Bryant," a same sex couple residing in Austin, Texas one of whom has severe and immediate health concerns.

We are all waiting for a final decision on marriage equality. However, this couple may not get the chance to hear the outcome of this issue because one person's health. Therefore, a Travis County District Judge has ordered the County Clerk to act now in issuing a license for this medically fragile couple. It is important to note that this order applies only to the medically fragile couple who brought the court action. Any additional licenses issued to same sex couples also must be court ordered.

The County Clerk will comply with the Judge's order in full faith.

Battleground Texas Executive Director Jenn Brown issued the following statement:

"We're thrilled to celebrate such a joyous occasion, and to see Sarah Goodfriend -- who's been an important Democratic activist and was one of the very first Battleground Texas volunteers -- making history alongside her partner Suzanne Bryant. Hopefully one day soon we will be celebrating not just this marriage, but the right of couples across Texas to marry the one they love."
