Authorities not moving forward with charges against Peaceful Streets' Buehler

Austin Police Department and the Travis County Attorney's office has decided not to move forward with charges against Antonio Buehler.

Buehler was arrested while filming police back in August.

APD released the following statement...

Joint statement between APD, Travis County Attorney regarding arrest of Antonio Buehler On Sunday, August 2, 2015 around 1:35 a.m., the Austin Police Department arrested Antonio Buehler of the Peaceful Streets Project. The arrest was prompted from several incidents throughout the night where Buehler was explained the tolerance of a safe distance, warned verbally and directed by hand movements. Buehler did not comply with warnings given and was subsequently arrested for Interfering with Public Duties, Class B Misdemeanor, Resisting Arrest, Class A Misdemeanor and booked into the Travis County Jail.

Although the Travis County Attorney’s Office believes that APD had probable cause to make the arrest, given previous determinations by Travis County Grand Juries, they do not believe they can prove the case beyond a reasonable doubt. The threshold for a conviction is higher than that for arrest.

The Austin Police Department and Travis County Attorney have been working together to better identify the necessary actions to prove a charge beyond a reasonable doubt. In addition, the Travis County Attorney will undertake efforts to discuss reasonable conduct with the Peaceful Streets Project so they have a clear understanding of our interpretation of the law.

In consideration of this collaborative effort, the APD has requested the Travis County Attorney’s Office not to move forward with the prosecution of the charges against Mr. Buehler.
