Sheriff's deputies in Bastrop County say a drunk driver caused an accident that killed one person on Monday afternoon. A child remains in the hospital in critical condition.
Parts of both trucks involved can be seen scattered across SH304.
"It's very odd that at 1:00 p.m. on a Monday, to have an intoxicated driver," says Sgt. Dane Baker, Texas Highway Patrol.
23-year-old Phillip John, Jr. was driving a Chevy truck hauling a flatbed trailer, heading northbound.
Highway Patrol said he then drifted into the southbound lanes.
"Swerved one vehicle off the roadway. The other vehicle, traveling behind that vehicle, was not able to get out of the way and he struck that vehicle in the left side," says Sgt. Baker.
The driver of a Dodge pickup died at the scene. She has been identified as 60-year-old Jessie Lavern Davis.
A two-year-old child in the back seat was airlifted to Dell Children's Medical Center with critical injuries.
Davis was her temporary caretaker.
As for John, Jr., he was arrested and charged with intoxication manslaughter and intoxication assault.
Highway Patrol says there is no telling when a driver might be drunk.
"Most the time it's going to be on your Friday and Saturday nights, that's when people are off. To find a driver of a technically commercial motor vehicle, because it falls on the regulations due to what they're doing, is really odd to find someone like that. Not saying it doesn't happen, it's very rare," says Baker.
SH304 was closed in both directions at Tiner Cut for around four hours as authorities worked to clear the scene. It has since been re-opened.
We wanted to take a closer look at DWI arrests in the area, so we obtained the latest "No Refusal" numbers from the Austin Police Department.
The initiative ran from December 18th at 9 P.M. through January 3rd at 5 A.M. During that time, officers made 229 DWI arrests. There were also three minors charged with DUI.

Phillip John, Jr, age 23, of Cuero, Texas was arrest by Texas Highway Patrol today in connection with the fatal collision on SH 304 @ FM 2571 in Bastrop County. He has been charged with Intoxication Manslaughter and Intoxication Assault. The identities of the victims have not yet been released pending notification to the family.

Bastrop Police say only one child injured in crash allegedly caused by impaired driver. Original reports were that two children were injured. The child injured is in critical condition after being transported to Dell Children's Medical Center.
Two vehicles were involved in a collision on SH 304 at FM 2571 leaving one person dead.
The call to Bastrop Police came in around 1 p.m.
Bastrop police confirm that one adult person died on the scene. A truck pulling a trailer struck another vehicle sending 2 small children to nearby hospital.
Police have closed roads in the area. Expect extended lane closures as investigators work the scene.
