AUSTIN, Texas - A Round Rock man was arrested in connection with a shooting on East Sixth Street early Wednesday morning.
Rickey Lee Durham Jr., 25, was charged with first-degree felony possession of a controlled substance with intent to deliver.
According to an arrest affidavit, an Austin police officer reported they heard "multiple popping sounds" coming from the middle of the 400 block of E. Sixth Street around 1:56 a.m. Nov. 20. Men and women were running away from the Toulouse bar at 409 E. Sixth Street and the officer heard more popping sounds and saw two men struggling over a black rifle.
One man had the other in a bear hug from behind, holding onto the rifle. The man in the bear hug was detained and identified as Durham, according to the affidavit. The officer frisked Durham for weapons and reportedly found a cylinder in his pants pocket labeled "THC 16.89% CBD 0%" and "THC - Contains Marijuana. Keep away from children."
The officer opened the cylinder and found 14 small clear plastic bags of a bright white powdery substance which later tested positive to be cocaine, says the affidavit. Each bag contained about a gram of cocaine, the amount weighing a total of 11.1 grams.
The man who was struggling with Durham told the officer Durham had been reportedly selling cocaine inside Toulouse and had offered him to sell him some when he went to the restroom. He also said two women reported to him Durham had tried to sell them cocaine as well.
According to the affidavit, Durham reportedly had been kicked out of the bar for selling cocaine and then returned later with the rifle.
