Warrant issued for Taylor man who assaulted woman with bat, fractures arm

A warrant has been issued for a man after he used a metal bat to strike a woman, breaking her forearm, according to an Austin Police Department affidavit. 

On January 14, police responded to a call at St. David's Hospital in Austin about a report of a woman suffering injuries from a metal bat. According to the affidavit, the victim was being treated in the emergency room at St. Davids and was suffering from a radial fracture on her right forearm.

According to the affidavit, the incident happened in the woods behind a fire station near Reagen High School where the victim, who is homeless, usually stays. The victim says that the suspect, 33-year-old Moises Tovar-Gallegos, is also known to hang out in the area with his dog and girlfriend. 

The victim said that Tover-Gallegos' dog has been known to bite people before, so she told him to "keep the dog away." Tovar-Gallegos responded by saying "Don't be talking s*** to my dog." The two argued before the victim told her boyfriend that they should leave. 

According to the affidavit, the victim turned around to grab her purse and as she looked back towards Tovar-Gallegos, he swung a metal bat at her one time, striking her in the arm. Tovar-Gallegos then fled the scene with the bat and his girlfriend in a white 2007 Ford explorer.

On February 16, police were called back to the assault location after the victim stated that Tovar-Gallegos' was on scene with the same vehicle he fled in. Police found the vehicle and verified that it belonged to Tovar-Gallegos and his girlfriend and that the two lived in Taylor. 

Police obtained a photo of Tovar-Gallegos from a 2015 assault where he was the victim. Police used the picture in a line-up on March 4, where the victim positively identified Tovar-Gallegosas as the man who struck her with the bat. 

Based on the investigation, police issued a warrant for Tovar-Gallegos' arrest.

He is wanted for aggravated assault, a second-degree felony.
