Man accused of throwing 2-year-old out of third floor window in Austin

A father in Austin has been accused of throwing his 2-year-old child out of an apartment window, about 20 feet down, according to court documents.

On March 27, 2018 Austin police were called out to an apartment complex on Anderson Lane. When police arrived, a witness told them she observed an adult male throw a baby out of a third floor window and land on landscape rock. The witness said the 2-year-old barely missed the concrete sidewalk and air conditioning unit. The witness said she then saw a woman, later identified as the mother of the victim, run down stairs, pick up the baby and head to the parking lot.

When police went to the apartment, they found it empty. They later saw the victim's father, Fnu Faizullah, get out of a car in the parking lot. When asked  by officers where he was coming from, Faizullah reportedly told them the hospital because his son had fallen. Faizullah told officers the child had been running and fell out of a window. He said he tried to catch the 2-year-old from falling out, according to court documents.

Detectives said it was unlikely the child would have been able to fall out of the window due to the height of the window and the victim.

Police located the child at Dell Children's Hospital where officers were able to interview the mother. She told officers her child had fallen while at a park and did not mention anything about a window.

Medical staff at Dell Children's said the victim didn't have broken bones, but had a lot of bruising, cuts and abrasions.

Fnu Faizullah was charged with injury to a child, a third degree felony. His bond was set at $30,000.
