Appeal deadline looms in case involving Fort Worth 9-year-old on life support

An appeals court in Fort Worth has until Friday to revoke a judge's order that is keeping a 9-year-old girl on life support.

Payton Summons has been on life support for three weeks since arriving at Cook Children’s Medical Center in cardiac arrest

The hospital now considers her brain dead and said it is unethical to keep her on a ventilator machine 

A judge has ordered the hospital twice now to keep providing treatment for her while her family looks for other options.

Her family asked for two more brain tests Monday. They said they would agree to have her removed from life support if those tests show no improvement.

In its most recent appeal, Cook Children's argued the latest order violated court procedures.

The appeals court set a deadline for noon on the hospital's request but indicated a decision could come sooner.
