Arrest made in shooting near University of Texas

Austin Police have arrested an 18-year-old man accused of a weekend shooting at the Sigma Chi fraternity house. They say the suspect admitted to being intoxicated and on Xanax at the time. Police say they also found an AK-47 and a 40-caliber gun in his home on west campus.

APD is seeing a rise in violent crimes throughout Austin. When it comes to west campus, they say it has always been a very challenging area. Early Sunday morning was no different.

Security guards are often hired for fraternity parties,  to make sure nothing gets out of hand. Unfortunately in this case, things did.

"The security guards do their job. Obviously no one got hurt last night except for the security guard who got shot in the foot, which is really messed up. It's a shame that it happened but it could have been a lot worse," says Joe Lunghi, UT student.

UT students helped lead Austin Police to 18-year-old Daniel Hamilton Magee. He was arrested Monday and charged with aggravated assault with a deadly weapon. We've learned that Magee is not a student of the University of Texas, not a member of any fraternity and not a CHL holder. A search of the his residence resulted in more weapons being found, including an AK-47.

"Anytime that we have a situation where somebody has already shown that they can be violent, and that we also find an AK-47, we're clearly going to continue to investigate this case. It's already been said that there may potentially be other charges," says Assistant Chief Troy Gay, Austin Police Department.

It was around 3:00 Sunday morning when officers responded to a shooting at 2701 Nueces St., which is the Sigma Chi fraternity house.

Police said Magee had to be physically removed from the party after refusing to leave. He then reportedly made verbal threats about returning with a weapon and 45 minutes later, that happened. Police say Magee showed up with two other men and displayed a gun. An altercation occurred and a security guard was shot in the foot.

"It's kind of embarrassing for the person, I think. To come back after you've been kicked out, with a weapon, you have nothing better to do than make a fool of yourself like that and to scare people for no good reason," says Lunghi.

Magee told police he was highly intoxicated and on Xanax at the time.

"Number one, if you're not 21 you shouldn't be drinking. Number two, if you are you should drink responsibly," says Assistant Chief Gay.

"I think the thing that actually kind of worries me more, is the fact that he did have an AK-47 in his apartment too. I mean, especially with the new campus carry laws, I feel like a lot more people probably decide to carry now. Maybe that's a good thing, maybe it's not," says Blake Bachellor, a UT student.

Police have yet to find the weapon used in the shooting. The other two men with Magee that night will not face any charges.


The Austin Police Department says that one person has been arrested in connection to the shooting near the University of Texas on September 11. 18-year-old Daniel Magee is not a UT student and has been charged with aggravated assault.

Three others were taken into custody but have not been arrested or charged with anything at this time.

Magee is currently in the Travis County Jail.

Police responded to a call of a shooting around 3 A.M. on September 11 at 2701 Neches. They say a person was asked to leave a party that was going on. That person returned after leaving which led to an altercation and a security guard being shot.

The guard was taken to the hospital and is expected to be okay.
