No charges filed yet for newborn found in dumpster

No charges have been filed at this time in the case of a newborn baby found in a dumpster last week.

The newborn was found Wednesday morning in a dumpster at the Mira Vista apartments in Austin; that’s near Rundberg and I-35.

Wednesday, a spokesperson for CPS told FOX 7 that the child remains in the Dell Children's Hospital; in state custody. She is listed as being in fair condition.

FOX 7 was told that the siblings of the baby, who were removed from the mother, are safe and with family members.

Officials with the Austin Police Department tell FOX 7 the case remains under investigation by a detective with the child abuse unit. State officials say the next step for them will be what’s called an “Adversary Hearing” where the baby’s family will let a judge know if they will contest the removal or agree with it.
