San Marcos PD issues alert about Kidnapping

A search is underway for a man who police say kidnapped and sexually assaulted a 7 year old girl in San Marcos.

The pink chalk used to write on a sidewalk in a west San Marcos apartment complex is typically used by kids at play. But the message put there Tuesday offers a very adult warning, it says; "don’t mess with my family."

The message was written by the 12 year old sister of the child who was attacked Monday at the apartments which are located near Wonder World Cave and Park. The mother of the 7 year who was kidnapped and attacked - declined to appear on camera - but she agreed to speak to FOX 7 from her front door.

"Yeah, I’m just thankful he did not take off with her ... he could have taken off with her and not brought her back."  

The man who took her daughter, according to a news release from San Marcos police, lured the girl into his car after claiming he hurt his back and needed help.

"She said that she had not seen him before. (A total stranger FOX 7) At this moment in time I’m guessing so, not unless it’s somebody that maybe lives close by or something, it’s not anybody she has seen before," said the girl's mother.

The man is described as; white or Hispanic, with short black hair and a close cut beard.  He allegedly drove to a nearby parking lot, where the assault took place. The girl says when she asked to go home, he let her out. She walked in the rain, and when home, told her mom what happened- who then called police.

Detectives are waiting for lab results, to see if any DNA evidence has been recovered. Investigators admit there is the possibility the story was made up, but it’s a gamble they are not willing to take.

Aubry Chagoya, who lives in the complex, says the 7 year old frequently plays with her cousin and is a good kid.

"I mean little kids do tell stories, but if it’s as detailed, as she has explained, then no I don't think she could have made it up," said Chagoya.

Police patrols are canvassing the area. It’s how they found a car which is similar to the sedan the kidnapper drove. But after questioning the owner the car was ruled out as the one they're looking for.

"I think that as always residents should be aware of their surroundings, and if they see suspicious behavior they should contact the police department," said SMPD Commander Kelly Earnest. 

Its advice Kandice Brawley says she will not ignore.

"I'll be fine, I think I'll be perfect, I will just have to watch out more, but I will be fine," said Brawley.

SMPD has not received any reports of similar kidnappings.


San Marcos police are on the lookout for a man who they say kidnapped and sexually assaulted an elementary school aged girl. It happened on August 29 in the 800 block of Bracewood Circle.

Police say the girl was outside her home when a white car pulled up to the apartments. The victim says the man driving the car asked her for help because his back was hurt and pulled her into the car when went over to help.

The suspect drove to and parked in a nearby parking lot where he exposed himself to the girl and assaulted her.

Police say the girl told the suspect she needed to go home and he let her out of the car. She walked home in the rain and told her mother what happened. The victim's mother then contacted police.

The time frame for the incident is around 5:30 p.m. to 6 p.m.

The suspect is described as a skinny white or Hispanic male with short black hair and a short black beard, possibly a goatee. No age range was given.

The car is described by the victim as looking similar to a 2011 Nissan Sentra with a possible dent on the driver's side.
